CONSTITUTION


According to the Unixplorian Constitution of 2001, public power is divided into four parts:

 

§ 1.1

The Executive (ruling) strength lies with the king. The king and the king's advisors (in the form of cabinet ministers) are, in turn, legally responsible to the parliament, which in turn is accountable to the Unixplorian people.


§ 1.2

The taxing power lies with the parliament (except municipal taxation).

Legislative power is shared as follows:

 

§ 2.1

The joint legislative power is shared between the king and the parliament;

 

§ 2.2

because of parliamentary taxation power, a part of the legislative power is solely reserved for the parliament, especially regarding appropriation issues (which, however, is not considered national law because it is regulated as a contract between the municipality and a citizen of the said municipality);

 

§ 2.3

these provisions will, according to the interpretation given above, be vested "by the decision of Parliament" even though the monarch has the final authority;

 

§ 2.4

the power of taxation is included as state regulation, i.e., allocating different parts of government activities in the state budget called the National State.

 

§ 3.1

economic, legislative power, which is reserved for the king alone, is about the control of authorities (executive power) and of more or less short-term provisions for the society as a whole, i.e., trade, enterprise, specific civic duties, health regulations and more;

 

§ 4.1

Each new legislative bill is revised at the beginning of every new election term or if the occasion calls for it.

 

§ 4.2

The judicial power lies with the Supreme Court, whose members are appointed by the king in concordance with parliament. The members of the Supreme Court are elected on the grounds of political color, and power is distributed according to the latest election results.

 

§4.3

The honorable judges of the Supreme Court always interpret new legislation. Any other authority cannot revoke a decision ruled by the Supreme Court except for a granted pardon by the king.

 

§ 4.4

The authority bestowed on the king by tradition can be taken away from the monarch if the Unixplorian people choose to criticize in a public referendum. The heir to the throne will then take the king's place as monarch.

What is a Unitary Constitutional Monarchy?


A unitary state is a state governed by a single power. Unitary states are contrasted with federal countries such as the United States or Germany.

 

A Unitary state does not necessarily imply that the nation is a democracy; most unitary states are not. The Kingdom of Unixploria is proud to be a fully functioning democracy.

 

Our constitution stresses that all power comes from the people; the people elect the members of Parliament and can take that power away.

 

Unixploria is a constitutional monarchy. A constitutional monarchy is a form of polity in which the monarch exercises their powers through a constitution and legal framework.

 

Constitutional monarchs are therefore bound to exercise their powers and authorities within limits prescribed in the legal framework.

 

The Unixplorian constitution grants sovereign powers, but these powers are far from absolute. All political decisions are shared between the king and Parliament.
